This song IS played in Drop D...Kutless's whole debut album is in Drop D...and Id suggest changing the Em to an Em7. you can tell he's playing this chord when you listen to the picking in the verse.

Yup, Its In Drop D. Just Look At The Video Of It, In The Chorus, They Only Use ONe Finger ON THe Lat Two Chords Of The Three.
