Thats how the intro is played by the lead guitarist on the Gretsch.
Check it out on the DVD of United We Stand - its definitely capo on 8th fret.
Im pertty sure the solo is also played with capo on 8th but havent had time to figure that out yet.

This is my first tab, so any feedback would be appreciated. I hope this helps someone.
Its way easier to play with capo and sounds EXACTLY the same as on the DVD.
